Terms and Conditions

Below you will find our general terms and conditions and our cancellation statement.

1. GENERAL, SCOPE OF THE GTC

  • 1.1These General Conditions (hereinafter "GCS") of Colleverde s.r.l (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller in relation to the Seller of goods presented in his online store. The inclusion of the customer's own conditions is contradicted, unless something else has been agreed.
  • 1.2The data controller on this website in accordance with the General Data Protection Regulation (GDPR) is Colleverde S.r.l, Vocabolo Coldipozzo 48, 06012 Città di Castello, PG, Italy. E-mail: info@villabizzishop.com . The person responsible for the processing of personal data is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data.

2. CONCLUSION OF THE CONTRACT

  • 2.1The product descriptions contained in the seller's online shop do not represent binding offers by the seller, but serve to enable the customer to submit a binding offer.
  • 2.2The customer can submit the offer via the online order form integrated in the seller's online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding contract offer in relation to the goods contained in the shopping cart by clicking on the button concluding the ordering process.
  • 2.3The seller can accept the customer's offer within five days,
    • by sending the customer a written order confirmation or an order confirmation in text format (fax or e-mail), whereby the receipt of the order confirmation by the customer is decisive, or
    • by handing over the ordered goods to the customer, where the receipt of the goods by the customer is decisive, or
    • by asking the customer to pay after placing the order. If there are more than one of the above alternatives, the contract is concluded when one of the above alternatives occurs first. The deadline for accepting the offer starts on the day following the sending of the offer by the customer and ends at the end of the fifth day following the sending of the offer. If the seller does not accept the customer's offer within the aforementioned period, this is considered a rejection of the offer with the result that the customer is no longer bound by his declaration of intent.
  • 2.4If you select a payment method offered by PayPal, your payment will be processed via the payment service provider PayPal (Europe) S. à r.l. et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal" ), under the terms of PayPal - Terms of Use, available at https://www.paypal.com/en/webapps/mpp/ua/useragreement-full or - if the customer does not have a PayPal account - the conditions for payments without a PayPal account, can be viewed at https://www.paypal.com/en/webapps/mpp/ua/privacywax-full. If the customer pays using a payment method offered by PayPal which can be selected in the online ordering process, the seller already declares acceptance of the customer's offer the moment the customer clicks the button concluding the ordering process. If you select payment by credit card, your payment will be processed through the payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland, located in Dublin, Ireland, conditions of 'use available at https://stripe.com/gb/legal/end-users
  • 2.5When submitting an offer via the seller's online order form, the contract text is saved by the seller after conclusion of the contract and sent to the customer in text form (e.g. e-mail, fax or letter) after that the order has been sent. The seller does not make the text of the contract accessible beyond that.
  • 2.6Before forwarding the binding order via the seller's online order form, the customer can identify any input errors by carefully reading the information displayed on the screen. An effective technical means for better recognition of input errors can be the browser's enlargement function, with the help of which the screen display is enlarged. The customer can correct his entries as part of the electronic ordering process using the normal keyboard and mouse functions until he clicks the button which completes the ordering process.
  • 2.7Only the English language is available for the conclusion of the contract.
  • 2.8Order processing and contact are usually institution made by e-mail and automatic order processing. The customer must ensure that the email address provided by him for order processing is correct so that emails sent by the seller can be received at this address. When using SPAM filters, the customer must ensure that all e-mails sent by the seller or by third parties contracted to fulfill the order can be delivered.

  • 4.3If the payment method "PayPal" is selected, PayPal will collect the invoice amount from the customer's bank account on behalf of the seller after a SEPA direct debit mandate has been issued, but not before the deadline for information anticipate. Pre-notification ("pre-notification") is any message (e.g. invoice, policy, contract) to the customer announcing a debit via SEPA Direct Debit. If the direct debit is not redeemed due to insufficient funds in the account or because incorrect bank details were provided, or if the customer objects to the debit although he has no right to do so, the customer must bear the costs incurred by the respective bank he is responsible for it.

  • 4.1The goods are delivered to the delivery address specified by the customer, unless otherwise agreed. For the processing of the transaction, the delivery address specified in the order processing of the seller is decisive. • 4.2If delivery of the goods fails for reasons attributable to the customer, the customer shall bear the reasonable costs incurred by the seller as a result. 8. APPLICABLE LAW

For all legal relations between the parties, the law of the Italian Republic applies, including the laws on the international purchase of movable property. For consumers, this choice of law only applies to the extent that the protection granted is not revoked by mandatory provisions of the law of the state in which the consumer has his habitual residence.

9. JURISDICTION

If the customer acts as a trader, a legal entity under public law or a special fund under public law with its registered office in the territory of the European Union, the exclusive place of jurisdiction for all disputes arising from this contract is the place of business of the seller. If the customer is based outside the territory of the European Union, the exclusive place of jurisdiction for all disputes arising from this contract is the seller's headquarters, if the contract or the claims arising from the contract can be attributed to the trader or the trader of the business customer. In cases above, however, the seller always has the right to appeal to the court of the customer's headquarters.
